Privacy Policy

Kelley Information Technology (“Kelley IT,” “KIT,” “we,” “us,” or “our”) is committed to protecting the privacy and security of information entrusted to us. This Privacy Policy describes how we collect, use, disclose, and safeguard information in connection with our website, communications, and professional IT services. This Privacy Policy is intended for business-to-business (B2B) use and does not create contractual obligations beyond those expressly agreed to in writing.

1. Scope of This Privacy Policy

This Privacy Policy applies to visitors to https://kelleyitsupport.com, prospective business clients, authorized representatives of client organizations, and individuals who communicate with Kelley IT regarding professional IT services. This Privacy Policy does not apply to information processed solely on behalf of clients while providing managed IT services or break-fix support, or to client systems, networks, applications, or data environments governed by a Master Service Agreement (MSA), Statement of Work (SOW), Non-Disclosure Agreement (NDA), Business Associate Agreement (BAA), or other service contract. Client data accessed during service delivery is governed exclusively by applicable contractual agreements, not this Privacy Policy.

2. Information We Collect

A. Business Contact Information

We may collect business-related information such as name, company name, job title, business email address, business phone number, and mailing address

B. Website and Technical Information

When you visit our website, we may automatically collect IP address, browser type and version, device identifiers, operating system, pages viewed and interaction data, and date and time of access.

C. Service-Related Information

In connection with providing IT services, we may access or receive support ticket information, system and device metadata, network diagnostics and logs, and information required for troubleshooting, maintenance, or security support. Kelley IT does not claim ownership of client data accessed during service delivery.

3. How We Use Information

We use information for legitimate business purposes, including to respond to inquiries and service requests, provide managed IT services and break-fix support, maintain business operations and internal records, improve our website and service offerings, communicate regarding services, updates, and business matters, and comply with legal, regulatory, and contractual obligations. We do not sell personal information.

4. Legal Basis for Processing (B2B Context)

Information is processed based on performance of a contract or pre-contractual obligations, legitimate business interests, consent where applicable, and compliance with applicable laws and regulations. Most information collected is professional or business contact information, not consumer personal data.

5. Data Sharing and Disclosure

We may disclose information in the following circumstances.

A. Service Providers

We may share information with trusted third-party service providers that support our operations, including cloud hosting and infrastructure providers, security, monitoring, and management platforms (RMM/PSA), CRM, billing, accounting, and payment processing systems, and website analytics and marketing tools. These providers are contractually required to protect information and use it only for authorized purposes.

B. Legal and Regulatory Requirements

We may disclose information to comply with applicable laws, respond to lawful requests, or protect the rights, property, or safety of Kelley IT, our clients, or others.

C. Business Transfers

Information may be transferred as part of a merger, acquisition, reorganization, or sale of assets.

6. Data Security

Kelley IT implements reasonable administrative, technical, and physical safeguards designed to protect information, including access controls and authentication mechanisms, encryption where appropriate, monitoring and logging, and incident response and risk management procedures. No system can be guaranteed 100% secure. Kelley IT disclaims liability for unauthorized access beyond reasonable safeguards.

7. Data Retention

We retain information only as long as necessary for legitimate business purposes, as required by applicable law or regulation, or as required by contractual obligations. Client service data is retained and handled in accordance with applicable service agreements.

8. Florida Information Protection Act (FIPA)

Kelley IT complies with the Florida Information Protection Act of 2014 (FIPA). In the event of a data breach involving personal information as defined under Florida law, Kelley IT will conduct a prompt investigation, take reasonable measures to mitigate harm, and provide notifications as required by applicable law.

9. Individual Rights

Depending on applicable law, individuals may have the right to request access to certain information, request correction of inaccurate information, or request deletion of information where legally permissible. Requests must be submitted in writing to [email protected]

We reserve the right to verify identity and deny requests as permitted by law.

10. Business-to-Business and Legal Exemptions

Certain privacy laws provide exemptions for business-to-business communications, professional contact information, and information processed pursuant to service contracts. Kelley IT relies on these exemptions where applicable.

11. Case Studies, Marketing, and Service References

Kelley Information Technology may develop case studies, project summaries, testimonials, or other descriptive materials relating to services provided for marketing, educational, or business development purposes. In preparing such materials, Kelley Information Technology omits, anonymizes, or aggregates confidential, proprietary, or sensitive business information; does not disclose security configurations, credentials, access methods, system architecture, or non-public operational details; does not publish personal information unless expressly authorized in writing; and avoids identifying specific clients, systems, or environments unless prior written consent has been obtained. Unless otherwise agreed in writing, client names, logos, trademarks, or identifying information are not used in public-facing materials. Descriptions of services or outcomes may be generalized to prevent attribution to any specific organization. Nothing in this section modifies or supersedes confidentiality obligations contained in any applicable service agreement, NDA, or SOW.

12. Regulated Industry Data (Healthcare, Financial, Legal)

Kelley Information Technology provides IT services to organizations operating in regulated industries, including healthcare, financial services, and legal professions. When providing services to regulated clients, Kelley IT acts solely as a service provider or business associate as defined by applicable agreements, accesses regulated data only as necessary to deliver contracted services, does not use regulated data for marketing, analytics, or unrelated purposes, and handles data pursuant to the applicable service agreement, BAA, or confidentiality agreement. This Privacy Policy does not expand or replace contractual obligations related to regulated data.

Healthcare and HIPAA

Where required, Kelley IT may enter into a Business Associate Agreement (BAA) with covered entities under HIPAA. Kelley IT does not create, own, or control Protected Health Information (PHI). PHI is accessed solely to perform contracted services. HIPAA obligations are governed exclusively by the BAA and applicable service agreements.

Financial Services and Payment Information

Kelley IT may support clients subject to GLBA, PCI DSS, or similar financial regulations. Kelley IT does not store payment card data unless expressly required by contract. Access to financial systems is limited to operational IT support. Compliance responsibility remains with the client unless explicitly assumed in writing.

Legal Industry and Privileged Information

When supporting law firms or legal organizations, Kelley IT does not assert ownership or control over privileged or confidential information. Access is limited to technical support and system maintenance. Confidentiality obligations are governed by applicable agreements and professional standards.

13. Cookies and Website Tracking

Our website may use essential cookies required for site functionality and analytics cookies to understand website usage. You may manage cookie preferences through your browser settings. Disabling cookies may affect website functionality.

14. Children’s Privacy

Our website and services are not directed to children under the age of 13. Kelley IT does not knowingly collect personal information from children.

16. Limitation of Liability

To the fullest extent permitted by law, Kelley IT disclaims liability for unauthorized access, data loss, or misuse beyond reasonable safeguards. This Privacy Policy does not create warranties, guarantees, or contractual rights. Liability related to services is governed exclusively by applicable service agreements

17. Changes to This Privacy Policy

Kelley IT may update this Privacy Policy at any time. Changes are effective upon posting. Continued use of our website or services constitutes acceptance of the revised policy.
